According to the results of the documentary tax audit, the large importer was fined for more than 2,5 millions hryvnas. The tax police decided not to wait until the court would adjudicate the tax case. The tax police stated a criminal case against the director of the company on the base of Part 3 of Article 212 of the Criminal Code of Ukraine (tax evasion in large amounts).

The criminal case was sent to the court with an indictment after the pre-trial investigation. On the base of allTax recommendation, the importer conducted a state economic examination, which refuted the position of the investigation. The prosecutor's office began to delay the trial and offered to re-qualify the indicement from Part 3 to Part 1 of Article 212 of the Criminal Code of Ukraine and close the criminal case on the base of limitation of the terms. The prosecutor made such an offer after the successful cancellation by the Supreame Administrative Court of tax decisions-notifications (penalties) in the amount of more than 2,5 millions hryvnas. Defenders rejected such offer and insisted on acquittalation of the director. The prosecutor's office continues to drag out the case.
